PHOTOGRAPHY TERMS & CONDITIONS

These Terms & Conditions (“Terms”) outline the policies, expectations, and responsibilities between Temple of Enchantment LLC (“Photographer”) and the Client. By booking a session, paying a retainer, or signing a photography

1. Booking & Payment Policy

1.1 Retainer

A 30% non-refundable retainer is required to secure the session date and time. No dates are held without retainer payment. The retainer compensates Temple of Enchantment LLC for reserving your date, turning away other clients, and all preparation work completed prior to your session.

1.2 Payment Schedule

  • 30% non-refundable retainer due at booking

  • 50% of remaining balance due on or before the day of the session

  • Final 20% due before delivery of the final edited gallery

1.3 No-Refund Policy

All payments made to Temple of Enchantment LLC are non-refundable, no exceptions. This includes the retainer and any additional amounts paid toward the session balance.

If a Client cancels for any reason — including personal emergency, illness, scheduling conflict, or change of mind — no refunds will be issued for any amount paid. Payments may be applied as a credit toward a rescheduled session at Photographer's sole discretion, subject to availability and the rescheduling terms in Section 1.5.

1.4 Last-Minute Bookings & Cancellations

For sessions booked within 72 hours of the scheduled date ("last-minute bookings"), the full session balance is due at the time of booking and is non-refundable in its entirety. This reflects the Photographer's immediate commitment of time, preparation, travel, and scheduling resources. Cancellation of a last-minute booking forfeits the full amount paid, with no credit or rescheduling option.

1.5 Rescheduling

Rescheduling requests must be made at least 72 hours before the session. One courtesy reschedule may be offered at Photographer's discretion. Rescheduling within 72 hours of the session is treated as a cancellation and is subject to the No-Refund Policy above.

1.6 Accepted Payment Methods

Stripe, Venmo, or PayPal unless otherwise stated.

1.7 Failure to Pay

Galleries will not be delivered until the final balance is paid. Late payments may delay delivery.

2. Rescheduling & Cancellations

2.1 Client Rescheduling

  • Retainer is non-refundable, but may be transferred once if Client provides at least 7 days’ notice.

  • Rescheduling within less than 7 days may require a new retainer.

2.2 Photographer Rescheduling

If Photographer is unable to attend due to illness or emergency, Client may:

  • reschedule at no cost, or

  • receive a full refund, including retainer.

2.3 Weather

Outdoor sessions will be assessed case-by-case. If weather conditions make photography unsafe or impossible, the session will be rescheduled.

3. Editing, Retouching & Revision Policy

3.1 Editing Style

Client acknowledges that Photographer’s editing style is consistent across her body of work and hires her based on her artistic judgment.

3.2 What Is Included

Standard editing includes:

  • color correction

  • exposure adjustment

  • minor blemish removal

  • light, natural retouching as needed

3.3 What Is NOT Included

Major alterations are not included:

  • reshaping body or face

  • smoothing skin extensively

  • altering facial features

  • removing wrinkles, creases, or textures

  • swapping backgrounds

  • removing or adding objects

  • advanced Photoshop composites

These edits, if possible, may be offered for an additional fee.

3.4 Revision Policy

  • Client receives one round of minor revisions on the delivered gallery.

  • Additional revisions are billed at $75 per revision round or $25–$50 per image, depending on complexity.

  • All revision requests must be submitted in one consolidated message.

  • All revision requests must be submitted within 5 days of gallery delivery. After this, edits are final.

3.5 Image Selection

  • Photographer selects the best images for editing and delivery.

  • If Client prefers to choose images themselves, they must do so within 5 days of receiving preview proofs. After 5 days, Photographer will proceed with her selections.

4. Delivery Timeline & File Storage

4.1 Turnaround Time

Standard delivery is 3-6 weeks from the session date.

4.2 Expedited Delivery

A 7-day expedited delivery option is available for an additional $200–$500, depending on the session type, package, and the number of images included. Expedited fees are due in full at the time of the request and are non-refundable.

4.3 Online Gallery Access

Client has 60 days from delivery to download all final images.
After 60 days, the gallery may expire.

4.4 Archives

After expiration:

  • Images are stored on Photographer’s archive drive.

  • Retrieval incurs a $75 archive reactivation fee.

  • Archived files are kept for up to 1 year, though not guaranteed.

Photographer is not responsible for lost images after the 60-day download period.

5. Additional Images

Packages include a set number of edited images.
Additional images may be purchased for $25 per image unless otherwise stated.

6. Copyright & Usage

6.1 Copyright

All images are the intellectual property of Temple of Enchantment LLC.

6.2 Client Usage

Client receives a personal-use license to download, print, and share images on social media.

6.3 Commercial Use

Commercial or promotional use (including for brands or businesses) requires a commercial license unless included in the package.

6.4 Photographer Usage

Unless Client requests privacy in writing before the session, Photographer may use images for:

  • portfolio

  • website

  • marketing

  • social media

  • promotional materials

7. Liability

Photographer is not responsible for:

  • accidents

  • injuries

  • weather conditions

  • location restrictions

  • clothing, hair, or makeup issues

  • delays caused by Client

  • unsupervised children

  • lost or damaged personal items

Maximum liability shall not exceed the total amount paid by the Client.

8. Model Release

By booking, Client grants Photographer permission to photograph and use their likeness as stated in Section 6.4 unless they opt out in writing prior to the session.

9. Client Cooperation

Client agrees to:

  • arrive on time

  • follow session guidelines

  • communicate respectfully

  • provide consolidated feedback

  • Client acknowledges that editing style and artistic decisions are at the sole discretion of the Photographer. Requests for stylistic changes beyond the Photographer’s established editing approach are not included and may incur additional fees.

Failure to cooperate may affect results; Photographer is not responsible for outcomes impacted by Client behavior.

10. Agreement

By booking, paying a retainer, or signing a contract, Client acknowledges they have read, understood, and agreed to all Terms & Conditions listed here.
